Since last month’s Digibiz, Knexus held a very interesting and thought provoking collaborative session around the new privacy laws governing electronic communications.

For those of you that are not familar with the new laws, from 11 December, you will need to get permission from prospective customers to email or text message them direct about your services. On your website, you will need to have clear guidelines about how your company uses cookies and whether consumers should accept them or not.

While on the surface, these seem quite innocuous laws, the debate around actual interpretation of the law will continue. For example, companies can continue to market to customers "in the context of a sale" for the purpose of marketing their own "similar products or services." In other words, if a customer has started to make enquiries but failed to purchase the product, you should be allowed to continue to market to them. However as one insurance company – who attended the collabortative session – pointed out: a lot of customers come to its website to get a quote and compare prices. Does this mean that the company can market to these customers even though no negotiations or a sale took place?

At the same session, another area that sparked off debate along the members at last month’s collaborative session was the use of cookies on websites. While the majority of companies have recognised that cookies are useful to track user patterns and behaviour, the rest of the general public still perceive cookies with intrepediation. Therefore the new rules asking companies to encourage prospective customers to turn off their cookies will cut off a valuable source of information.

It is interesting to note that while consumers are encouraged to opt out of receiving cold calls or junk mail from companies, the new rules take an alternative approach by asking consumers to opt-in to receive marketing material. Surely it would have made sense to follow the opt-out approach to give consumers a more consistent view of eMarketing.

So these new rules will come into effect on 11 December. But the real test is going to be afterwards. While the majority of sensible companies will abide by the rules, the first real test case is going to have a dramatic affect on the industry in determining the actual interpretation and how far the law will go to protect consumers and yet penalise the company at the same time.

Knexus Community will continue to monitor the situation and will share with you the guidelines once they have been issued by the Information Commission later this month. We will also be revisting this subject in June 2004 (i.e. six months after the legislation takes effect).

Enterprise Communities – A Strategic Tool for Global Effectiveness
Collaborative Session – 14 January 2004

To kick off 2004, Knexus Community is holding the latest in a series of member gatherings to assess the potential of Strategic Enterprise Communities and understand where and how members are using Communities. With the pressure on companies to unlock economic value within their businesses, it is vital that organisations are able to drive collaboration and sharing across their business units. The role of strategic enterprise Communities is seen as the potential solution to enable this to happen.

British American Tobacco (BAT) is hosting this collaborative session and will share with the members exactly what it is doing with its Community initiative.

If you are a senior manager in strategy, knowledge management or marketing who is actively using strategic enterprise Communities or are considering their potential, then this is one collaborative session that you will not want to miss. Content Strategy – delivering compelling content online

Does your company provide compelling content that motivates better self-service among your customers and drives them to purchase from you? Do you have a clear and scalable approach to generating suitable content for your online customers from within your organisation?

Knexus Community is holding a collaborative session to address how content is tackled within organisations. Companies need to bring together customer service, sales and marketing content to support their online customers. By having compelling content, customers will use the website more effectively and have the trust to conduct more business with you.

Knexus member BT has overcome this problem by establishing a robust content strategy. BT’s Major Business division, which is responsible for managing its B2B corporate customers, has implemented its content strategy within its division to ensure consistency and timeliness of content, as well as addressing organisational, people, governance, ownership and process issues.

Knexus Community Update
  eMarketing – Changing the Ground Rules
22 October 2003 – Feedback

Last month Knexus held a very successful session around the impending new rules governing electronic communications and whether marketing material can be sent to prospective and existing customers.

It was agreed in summary that:

– Companies have until 11 December to make changes to their eMarketing and cookies’ policies
– Be more transparent to users over what they receive

For further lessons learnt from this session, make sure that you access the outputs.
